Terms and Conditions

These Terms and Conditions (hereinafter “Terms”) shall govern the use of the TGM Services, as defined below.

TGM provides a global online and mobile platform for market and opinion research.

TGM and its affiliates (hereinafter “TGM”, “us”, “our” or “we”) offers a service (the “Service”) that allows users (hereinafter “you” or “User”) to access materials, opinions, reports, and other content (the “Content”) made available via the Service.

The Service is made available to you under the Terms by TGM Research PTE. LTD.

TGM provides the Service subject to the Terms. If you do not agree to the Terms, you may not use the Service nor access or consume any Content provided via the Service.

1. Service


1.1. The User selects Content from the TGM offer and places an order using an online form.

1.2. To access our Services, you don’t need TGM Panel account.

1.3. Prices are displayed on TGM’s website and will be clearly communicated.

1.4. The price of Content does not include the delivery charge. Delivery of the Content takes place in digital form specified by TGM, e.g. the Content is made available for download, or the Content is sent to the email address specified in the order form.

1.5. Confirmation of the order by TGM is a condition for its processing. The confirmation contains information that the order has been accepted and that payment has been completed.

1.6. If an order is not confirmed, TGM should be notified via: contact.statbox@tgmresearch.com.

1.7. It is recommended that the Content be downloaded immediately upon notice.

1.8. TGM undertakes to make it possible to download the Content to which the order refers for a period of 14 days, from the date of the order.

1.9. If the User has not downloaded the Content within the period referred, the User will lose the opportunity to download the Content and will not be entitled to a refund of any paid funds.

1.10. Each User receives a corresponding receipt, invoice, or purchase confirmation from TGM as proof of purchase of a Content.

1.11. After payment for the Content order, it is not possible to change the order.

1.12. Only orders that have not yet been completed can be cancelled, by which is meant the sending of a content file (e.g. via email) or if the content has not been downloaded within 14 days after it was made available (e.g. via link) and a cancellation declaration has been sent.

1.13. TGM offers a variety of payment methods for ordered Content including: credit card payment, transfer payment.

2. Limited warranty

2.1. TGM represents and warrants that it has the right and authority to make the online Services and Contents.

2.2. Users agree that use of the services is at User’s risk, except as otherwise provided in section 2.1, the Services and Contents are provided as is, and as available and that TGM make no warranty of any kind, express or implied, as to the Services and Content, including but not limited to non-infringement, title, or fitness for a particular purpose or use.

2.3. The User is responsible for all of his/her use of the Services.

2.4. Users are required to provide truthful and accurate information during ordering, including, but not limited to, correct shipping and payment information, correct contact information (e-mail, telephone, etc.), confirmation of payment arrangements and confirmation of the Terms.

2.5. TGM is not responsible for the actions of the User, including the data provided by the User.

2.6. Additionally TGM is not responsible for a temporary or permanent loss of Service resulting from a change in the User‘s e-mail address or contact information, intentionally or unintentionally, which has not been communicated to TGM in accordance with Terms.


3. Intellectual Property Rights

3.1. The Service and the Content is TGM and/or its licensors.

3.2. All trademarks, Service marks, trade names, domain names, patents, inventions, trade secrets, copyrights, database rights and all other intellectual or industrial proprietary rights (including know-how), in the Service or the Content are owned by TGM or its licensors, or any affiliated companies to TGM or its licensors.

3.3. No element of the Service or the Content may be used or exploited in any way other than as part of the Service offered to User and to the extent expressly permitted under the Terms or consent of TGM.

3.4. TGM does not transfer any rights (including intellectual property rights) or title to the Service or any part thereof to User, nor does TGM transfer any such rights or title to the Content or any portion thereof.

3.5. Unless otherwise indicated nothing shall be construed as TGM granting, by implication or otherwise, any license or right of use of any trademark displayed on or within the Service or the Content to User.

3.6. Users are granted a nonexclusive, non-transferable, limited right to access the Services and Content made available to User. The rights granted exclusively to Users are as follows:

  • The right to use Content for research purposes, and the right to copy Content into User‘s analyses, presentations, documents, and other similar forms of work or research material. That includes printing, and archiving for internal purposes and a fair use;
  • The right to publish and distribute Content under these Terms, unless otherwise prohibited by existing applicable intellectual property laws and copyright laws;
  • The right to Email, fax, download or make printouts using the commands of the Services and the right to create a single printout of Content accessed or downloaded by any other lawful means;
  • The right to display Content for non-commercial purposes, including the display of materials on blogs, social media platforms, and other strictly non-commercial websites, under the condition that published Materials are linked directly to TGM’s (In all cases, please contact us if you’d like to republish republish any of the Content);

3.7. Any form of commercial exploitation, distribution or publication other than those indicated in section 3.6. is strictly prohibited.

3.8. User may not use Content or link to TGM any site, materials or other content containing inappropriate, defamatory, infringing, obscene, or unlawful topics, names, material, or information that violates any applicable intellectual property, proprietary, privacy, or publicity rights.

3.9. Some datasets and indicators are provided by third parties and may not be redistributed or reused without the consent of the original data provider, or may be subject to terms and conditions that are different from those described above. Where applicable, these conditions are included in the dataset or indicator metadata.

3.10. We do not provide any of the raw data or files used to produce our Contents.

3.11. If possible and If you’d like to feature Content, the best solution is to re-embed the original Content.

3.12. It is possible to republish individual content elements as long as you comply with the following conditions:

  • You must not charge people for access to the Content;
  • You must republish each relevant page in its entirety and in its original design, including all dates, titles, flags, labels, data sources, footnotes, and brand logos;
  • You must not intentionally misrepresent or distort any data or analysis;
  • You must include clear attribution to TGM and the report partner detailed of the relevant source Content or data (if any);
  • You must include a clear URL or hyperlink to the relevant Content page on TGM Seriveces

3.13. Please note that we may charge fees for processing requests to access Content, which users must pay. This does not apply to content elements from publicly available sources.

3.14. If you’d like to reuse any of our materials in a paid publication, please contact us with details:

  • publication’s title, its author(s), the planned publication date, and the recommended retail price;
  • A brief description of the Content you’d like to include, and how it will appear in your publication;
  • Where relevant, a screen-grab of each element of Content you’d like to reuse – with the following details to assist in correct identification:
  • The name and email address of the entity to whom we should send the invoice for our processing fee.
  • The date by which you need to complete the approvals process.

3.15. Please note that we need time to process requests to use our content in paid publications, so please contact us as early as possible to secure the necessary consents in time for the publication deadline.

3.16. If you want to reference our Content in analyses, presentations, documents, and other similar forms of work or research material, we recommend the following citation style as indicated below in these Terms (Citation, republication)

3.17. If specifically labeled, Content are provided to you under a Creative Commons Attribution 4.0 International License (CC BY 4.0).

3.18. By downloading or using Content containing public data, you agree to comply with the terms of a CC BY 4.0 license.

4. Limitation of liability

4.1. TGM shall not be liable for any loss, injury, claim, liability, or damage of any kind resulting in any way from:

  • Any errors in or omissions from the Services or any Contents;
  • The unavailability or interruption of the Service or any features thereof or any Contents;
  • The loss or corruption of any data or equipment in connection with the Services;
  • Any delay or failure in performance beyond the reasonable control of a TGM;
  • Any content retrieved from the Internet even if retrieved or linked to from within the Services.

4.2. To the fullest extent permissible by applicable law, and under no circumstances will the total aggregate liability of the covered parties in connection with any claim arising out of or relating to the use of or inability to use the Services or Contents exceed the lesser of your actual direct damages or the amount paid by User.

4.3. In the event of a breach of the warranty contained in Section 2, TGM shall, at its sole discretion and expense, defend or settle any action and indemnify User for any proceedings or damages of any kind or description based on a third party's claim of patent, trademark, service mark, copyright or trade secret infringement in connection with User uses of the Services or Content brought against you by such third party, provided that:

  • All use of the Services and Contents was in accordance with this Terms;
  • The claim, cause of action or infringement was not caused by User;
  • User gives TGM prompt notice of any such claim;
  • User gives TGM the sole right to control and direct the investigation, defence and settlement of each such claim.

4.4. User agree, at its own expense, to indemnify, defend and hold TGM harmless from and against any and all claims, damages, liabilities, costs, and expenses, arising out of or in connection with the Services, or any links on the Services, including, but not limited to:

  • Violation of the Terms;
  • Any claim that any use of the Services by User infringes any intellectual property right of any third party, or any right of privacy or publicity;
  • Any deletions, additions, insertions or any unauthorised use of the Services or Contents by User.

5. Miscellaneous

5.1. TGM may, at its own discretion, make changes in the Terms.

5.2. When TGM makes changes to the Terms that negatively affects the Service, this will be communicated to User e.g. by sending an email, text message or a notification via the Service.

5.3. The Terms shall be governed and construed in accordance with the laws of Singapore, excluding its conflict of laws principles. However, the Terms will not limit any consumer protection rights that you may be entitled to under the mandatory laws of User country of residence if in conflict with the above.

5.4. Upon the breach of this Terms by User, TGM may temporarily suspend or discontinue providing access to the Services to the breaching party without notice, in addition to pursuing any other legal remedies available to TGM.

5.5. TGM‘s ability to provide Contents is regulated by a variety of privacy, data protection, and other laws in a variety of jurisdictions and by the licenses under which it obtains Contents.

5.6. TGM may perform periodic reviews of Users‘ use of Content subject to data laws or licenses in order to comply with data laws and license restrictions.

5.7. This Terms will be enforced to the fullest extent permitted by applicable law. If any provision of this Terms is held to be invalid or unenforceable to any extent, then:

  • Such provision will be interpreted, construed and reformed to the extent reasonably required to render it valid enforceable and consistent with its original intent and;
  • Such invalidity or unenforceability will not affect any other provision of this Terms.

5.8. The Controller of Users personal data is TGM.

5.9. The data collected may be processed to:

  • Conclude or perform the Terms;
  • Fulfilling orders placed or providing other services, including marketing services, by electronic means (including the dispatch of subscribed content), if the User has consented to the provision of such a service to him/her;
  • Fulfilment of legal obligations - if any;
  • The establishment, investigation or defence of possible claims by TGM;
  • Archival (evidential) in pursuit of TGM's legitimate interest in preserving information in the event of a legal need to prove facts.

5.10. The data may be shared with TGM employees or entities acting on behalf of TGM (service providers supporting TGM in its operations) and entities who’s right to access the data is based on the law.

5.11. Data will be processed until:

  • The fulfilment of the order;
  • Indicated by law or;
  • The expiry of any claims related to order.

5.12. You have rights in relation to the processing:

  • To access the data, to request rectification, erasure or restriction of processing;
  • To object or withdraw consent to the processing insofar as the processing is based on a legitimate interest tor your consent;
  • Lodge a complaint to a supervisory authority.

6. Citation, republication

6.1. 7. Complaints

7.1. In the event of any order problems, please contact TGM via contact.statbox@tgmresearch.com.

7.2. In the complaint, the User should provide their identification details, email address and a description of the problem.

7.3. Complaints will be processed no longer than 14 days after receipt.
